General terms and conditions of sale

They apply to the purchase of products sold by Baglio di Pianetto on the site shop.bagliodipianetto.it

The products on the site shop.bagliodipianetto.it (the site) are sold directly by  Baglio Di Pianetto Società Agricola Srl  (the seller), based in Contrà del monte 13 Vicenza, P.I.IT02940950245.

Each purchase transaction will be governed by the provisions of Legislative Decree 22 May 1999 no. 185, as well as Legislative Decree 6 September 2005 no. 206.

All contracts for the sale of Products by the seller to its customers through the site are governed by these Conditions of Sale, which form an integral and substantial part of each order and order confirmation of purchase of the Products themselves. The conditions of sale applicable to each purchase order are those in force on the date of the order itself.

The sales contracts of the products on the site are considered concluded when the purchase order placed by the customer reaches the seller and the latter accepts it.

Following the acceptance of the purchase order, the seller will promptly send the customer the receipt of the purchase order.

At present, the Online Sales service is available for Italy, Austria, Belgium, France, Greece, Germany, Ireland, Luxembourg, Netherlands, Portugal, United Kingdom, Czech Republic, Spain, Sweden, Hungary.

Orders

The products can only be purchased online by adult customers. The Customer, by sending the confirmation of his purchase order electronically, unconditionally accepts and undertakes to observe these general conditions of sale, declaring that he has read and accepted all the information contained therein. The Customer is required to carefully read the provisions regarding the “Right of withdrawal” before formalizing purchases via the internet.

How to buy

To make a purchase it is necessary to enter the file of the product you wish to purchase, select the quantity and any configuration. Once all fields have been selected, you can add your selection to your cart. It is possible to purchase only in multiples of 6 products.

Once the correctness of the selected products has been verified, by clicking on the “Proceed with the order” button, it will be possible to specify the billing information and then the shipping address. Once the Order Confirmation has been received, it is necessary to indicate the chosen payment method:

If you have chosen to pay through PayPal, you will be redirected to the dedicated site on the domain paypal.com, therefore beyond any competence of the seller. Once the payment has been made with one of the methods offered by PayPal, the site will automatically receive the notification of successful payment and will process the order. The seller will in no way be in possession of any data provided to PayPal and assumes no responsibility for it.

In case of payment by bank transfer, the shipment will take place after the payment has been credited. All the information useful for the execution of the bank transfer by the buyer, and for the recognition of this by the seller, will be provided to you when completing the order.

The recognition of the sender of the bank transfer will take place through the reason for this, in which the order number must be indicated, visible both during the purchase confirmation phase and received by email. For any problem, the customer can contact the assistance directly.

Once you have made the payment with the method you have selected, you will receive the Transaction Notification via email and the details of the products purchased.

Those who have chosen to pay with PayPal will also receive an email from the latter with the details of the transaction.

The method we have chosen is based on PayPal, used in many online shops, safe and reliable.

The pages intended to manage the transaction are protected with the SSL (Secure Socket Layer) protocol which uses a particularly solid and powerful algorithm.

All financial information such as credit card number and expiration date are therefore encrypted and only subsequently transmitted. When entering data relating to the credit card, the financial information is sent directly to the secure PayPal site. No one, including the site owners, will ever have access to your credit card, this guarantees maximum security.

The purchase can only be made by the cardholder. The seller will also accept orders addressed to people other than the owner, but reserving the right to carry out checks on the buyer and, at his sole discretion, to refuse the order.

The order amount will be charged only when the package is shipped.

The seller will send a regular invoice together with the shipment of the products.

Shipping cost

Orders are processed upon receipt of payment for the order.

Preparation and shipping times are approximately 3/4 days which may increase during the Christmas period and at the end of the year.

Italy

For orders up to €300.00, the cost of shipping is €30.00; 

For orders starting from euro 300.00 shipping is free.

Europe

Shipping

The order will be processed with times ranging from 3 to 6 working days.

Subsequently, once the shipment has been delivered to the courier who will deliver during normal working hours and delivery is made within 24/48 hours.

We advise you to choose a delivery address where our collaborators will surely find someone to make the delivery.

Deliveries outside Italy have different handling times based on the country of destination.

Upon receipt of the goods, before collecting them, check that:

• The packaging is intact, dry and not tampered with
• the number and identity of the packages corresponds to the data shown in the accompanying document.

Once any damages or non-correspondence of the indications are found, immediately contest the delivery to the carrier and report immediately to our customer service by writing to shop@bagliodipianetto.it or by calling the number +39 0918570002.

Diritto di recesso

The online sale of Baglio di Pianetto wines is governed by articles 50 – 68 of the Consumer Code (Legislative Decree 6 September 2005, n. 206). This legislation provides the consumer with the right to withdraw from contracts or contractual proposals, guaranteeing him the right to return the purchased product and to obtain reimbursement of the expenses incurred.

The customer has the right to cancel his order within 14 (fourteen) days from the date of delivery of the goods. This right consists in the right to return the purchased goods to the seller and in the consequent reimbursement of the purchase price and delivery costs.

Within the 14 (fourteen) days, the customer can withdraw from the contract without giving any explanation.

Once the Returns Acceptance has been received from our Customer Service, the customer has 14 (fourteen) days to return the item. The withdrawal must be communicated by registered letter with acknowledgment of receipt to:

The communication must contain the declaration of the intention to exercise the right of withdrawal, indicating one’s order number, invoice number and customer code, which products must be subject to withdrawal (identifying them with the article code), as well as the bank details on which obtain the bank transfer (IBAN).

Our customer service, having received the notice of withdrawal, will communicate the Acceptance of Returns (a UNIQUE CODE sent via email, to be printed, cut out and applied) so that you can return everything within the following 14 (fourteen) days.

According to the law (Law n.185 of 22/05/1999) the return of goods is subject to the following conditions:

the purchased good must be substantially intact (free from damage or tampering)

the costs for the return of the goods are charged to the customer.

Apply the Return Acceptance received on the shipped packages in a clearly visible position.

Shipments without Return Acceptance will not be accepted and will be returned to the sender, at his expense.

It is recommended, for the benefit of the customer, to prepare the package with care using suitable packaging (preferably the originals) and for shipping to use a courier or other suitable means to allow the traceability of the shipment.

The seller will reimburse the customer within 14 (fourteen) days of receipt of the returned goods.

 Minors

Baglio di Pianetto does not sell wine or other alcoholic products to anyone under the age of 18. The courier will not deliver wine or other alcoholic products to minors under the age of 18 and may request an identity document to verify age.

Jurisdiction

The sales contract between the customer and Baglio di Pianetto is understood to be concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Palermo.
